ESSENTIAL HAIR ACADEMY – AIR TOUCH BUNDLE AGREEMENT

Thank you for purchasing the Air Touch Bundle (“Course”) by Essential Hair Academy (“Company”).
All sales are final for this Course.

By clicking “Buy Now,” “Complete Order,” or any other phrase on the purchase button, entering your credit card information, or otherwise rendering payment for the Air Touch Bundle, you (“Customer”) agree to be provided with access to the Course created by Tim & Tabitha Duenas (“Creator”) in their capacity as owners of Essential Hair Academy (“Company”). You are executing a legally binding agreement with the Company, subject to the following terms and conditions:

1. INTRODUCTION

Essential Hair Academy (“Company”) provides educational materials and training for hairstylists.
The Air Touch Bundle is a one-time purchase digital course designed to educate stylists on color techniques and styling methods.

2. PAYMENT & FEES

(a) Upon execution of this Agreement, Customer agrees to pay to the Company a one-time payment of $333 USD (“Course Fee”) in full at checkout.

(b) Payment is due at the time of purchase. Access to the Course will be granted immediately upon successful payment.

(c) Customer authorizes Company to charge the credit card or account used at checkout to complete payment and acknowledges that no further authorization is required.

(d) If a payment attempt fails, Customer must update payment information within five (5) business days or risk forfeiting access to the Course.

(e) Customer shall not dispute or initiate chargebacks for the Course. Company reserves the right to collect any owed monies by lawful means, including the recovery of associated fees and attorneys’ costs.

3. TERM, TERMINATION & ACCESS

(a) Term – This Agreement is effective upon purchase and will continue for the duration of Customer’s access to the Course.

(b) Access – The Air Touch Bundle is a lifetime-access digital product unless otherwise specified.

(c) Termination – All sales are final. Dissatisfaction with teaching style, delivery, or subjective opinion is not grounds for termination or refund.

4. DISCLAIMERS

(a) The Company is not an employee, manager, lawyer, accountant, doctor, or therapist of the Customer.

(b) The Air Touch Bundle is an educational resource designed to provide general information and instruction. Customer acknowledges that results will vary based on individual implementation.

(c) Company does not guarantee specific results, financial gains, or outcomes. All actions and decisions made based on the Course content are solely the Customer’s responsibility.

(d) The Course may include access to third-party tools or platforms. The Company is not responsible for any issues caused by such third parties.

(e) This Course does not include: personalized feedback, business coaching, financial advice, legal consultation, or any service not explicitly listed in the Course description.

5. COURSE CONTENT

The Air Touch Bundle includes pre-recorded educational videos, tutorials, and resources for hairstylists.
Company reserves the right to modify, substitute, or update Course materials as deemed necessary.
Access is provided through ThriveCart, a third-party platform. Company is not responsible for technical issues or interruptions caused by third-party platforms.

6. CUSTOMER RESPONSIBILITIES

(a) Customer acknowledges that success depends on individual skill, effort, and application of the techniques taught.
(b) Customer agrees to act respectfully in any associated community spaces and to abide by all Company guidelines.
(c) Harassment, hate speech, or inappropriate conduct towards Company or other students will result in immediate removal without refund.

7. REFUND POLICY

All sales are final.
Due to the digital nature of this educational product, no refunds or credits will be issued under any circumstances.

8. CONFIDENTIALITY & NON-DISPARAGEMENT

(a) Confidential Information – Customer agrees that all materials, methods, and information shared in the Course are proprietary to the Company.
(b) Customer may not disclose, reproduce, or distribute any part of the Course.
(c) Testimonials – Customer agrees that Company may use general statements or success stories as testimonials in marketing materials.
(d) Non-Disparagement – Customer agrees not to make statements, oral or written, that may negatively impact the Company or its reputation.

9. INTELLECTUAL PROPERTY & LIMITED LICENSE

(a) All Course materials, videos, text, and content are the intellectual property of the Company.
(b) Customer receives a limited, personal, non-transferable license for personal use only.
(c) Customer may not reproduce, sell, share, or teach the Course content without written permission from the Company.

10. INDEMNIFICATION / LIMITATION OF LIABILITY

Customer agrees to hold harmless and indemnify the Company from any claims, damages, or losses arising from the use or misuse of the Course materials.
Access is provided through a third-party platform (ThriveCart), and the Company is not responsible for any limitations of access or platform issues.
Maximum damages, if applicable, shall not exceed the total cost of the Course.

11. MISCELLANEOUS

A. Amendments – The Company reserves the right to update or modify this Agreement.
B. Severability – If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full effect.
C. Entire Agreement – This document constitutes the full Agreement between the parties.
D. Governing Law – This Agreement shall be governed by and construed in accordance with the laws of California.
E. Arbitration – Any disputes shall be resolved through binding arbitration.
F. Execution – By purchasing the Air Touch Bundle and selecting “I agree to the Terms & Conditions,” Customer acknowledges full acceptance of this Agreement.
